Matthew Fox won't be charged in party bus incident

Actor Matthew Fox has escaped prosecution over an alleged attack on a female bus driver following an altercation in Ohio last month (Aug11).


The Lost star had attempted to board a party bus in Cleveland in the early hours of 28 August (11) when he was confronted by driver Heather Bormann because his name was not on the private guestlist.

A scuffle ensued, during which Matthew Fox is accused of hitting Bormann in the crotch and breast, prompting the female driver to punch the actor in the face.

He was detained by police after the incident, but was not formally arrested. Heather Bormann subsequently filed charges against the actor and cops launched an investigation into the claims.

However, officials at Cleveland Prosecutor's Office have since decided not to press criminal charges against Fox.

A representative tells TMZ.com, "There will be no charges brought. After a review of the facts (officials) came to the conclusion not to charge."

Fox, who was in Cleveland filming new movie I, Alex Cross, has yet to comment on the allegations.

Heather Bormann filed a lawsuit against him this week (begs12Sep11), demanding more than $25,000 for assault, battery and intentional infliction of emotional distress.

She insists she punched Matthew Fox in self defence.
